This website concerns a proposed settlement (the “Settlement”) of a lawsuit against RHG & Company, Inc. d/b/a Vital Nutrients (“Defendant”) on behalf of all Persons who purchased Vital Nutrient’s products in the United States during the period from August 1, 2012 to February 27, 2017, that contained an unqualified “Made in the USA” label, or were otherwise represented as being “Made in USA,” including on Defendant’s website, brochures, or any other marketing materials. The action is currently pending in the United States District Court for the Southern District of California (the “Court”). The Court has certified this action to proceed as a class action, for purposes of settlement only. This website is intended to: (a) inform you about the Settlement of this action and (b) advise you of your rights and your options regarding the Settlement.

This action alleges that Defendant violated California state law by improperly labeling and selling its products as being “Made in USA.” This action alleges that one or more components of Vital Nutrients’ products were sourced from outside of the United States. This action seeks, among other things, an award of damages against Defendant as a result of this alleged conduct.

How do I make a claim?

If you are a class member and want to get settlement benefits, you must submit a valid claim, either by postal mail or online, by November 27, 2017.

The rights and options of the class members—and the deadlines to exercise them—are explained in the Notice.
The Court in charge of this case still has to decide whether to approve the settlement. The settlement approval process takes time. Please be patient.

It’s Almost The 4th Of July – You MUST Read This RECALL on Fireworks – Injuries Reported

The Consumer Product Safety Commission has issued a recalled for fireworks just before the Fourth of July holiday weekend because of burn and injury hazards caused by unexpected explosions.

According to the recall alert, the TNT Red, White & Blue Smoke fireworks were sold at Walmart, Target, Meijer, Kroger and Albertsons stores in Ohio, Illinois Wisconsin and Vermont from May through June 2017.

There have already been three reports of burn injuries related to the product.

The recalled fireworks are pyrotechnic devices, CPSC says that make smoke when lit. They were sold in a bag containing three canisters: one red, one blue and one white. Each colored smoke firework is a cardboard cylinder tube that measures about 1 inch in diameter and 5 inches long.

The TNT logo, “Red, White & Blue Smoke” and UPC number 027736036561 appear on the packaging.

May 19, 2017– John Morrell and Co., a Cincinnati, Ohio establishment, is recalling approximately 210,606 pounds of ready-to-eat hot dog products that may be contaminated with extraneous materials, specifically metal, the U.S. Department of Agriculture’s Food Safety and Inspection Service (FSIS) announced today. The company that makes Nathan’s and Curtis hot dogs is recalling more than 200,000 pounds of the products after getting complaints of metal found in the packages.

John Morrell and Co., of Cincinnati, Ohio, said it had gotten three complaints and notified the federal government Friday. There have been no confirmed reports of injuries or adverse reactions from the products.

The recall applies to 14-oz sealed film packs labeled “Nathan’s Skinless 8 Beef Franks” with a use-by date of Aug. 19, 2017, and to 16-oz sealed film packs labeled “Curtis Beef Master Beef Franks” with a use-by date of June 15, 2017.

The packages have “Est. 296” on the sides and were shipped to retail locations nationwide.

Consumers who have purchased these products are urged not to consume them. These products should be thrown away or returned to the place of purchase.

PEPSI RECALL – MUST READ FOR PEPSI DRINKERS

PepsiCo has recalled certain 16.9 ounce Pepsi bottles sold this year in Michigan due to possible contamination from tiny metal flecks, according to a consumer advisory issued Monday by the Michigan Department of Agriculture and Rural Development.

An investigation initiated by a consumer complaint found that some of the bottles contained metal pieces between 0.1-0.3 millimeters in size, though some could be larger, as a result of an equipment malfunction during bottling. The metals were identified as iron and chromium, according to the report.

No known injuries or illnesses have been reported as a result of the contamination.

The recall applies only to 16.9 ounce regular, plastic Pepsi bottles sold in Michigan with product codes HC022373 and HC022473. It does not apply to Diet Pepsi, Pepsi Zero Sugar, or any other Pepsi flavors or bottle sizes.

Consumers who purchased the affected products should return them to the place of purchase for a refund, and all recalled bottles have been removed from store shelves.

Recall Alert – Aunt Jemima Products(including some Hungry Man Meals) Due to Listeria Contamination

Pinnacle Foods Inc. is voluntarily recalling all “Best By” dates of Aunt Jemima Frozen Pancakes, Frozen Waffles & Frozen French Toast Slices distributed nationally in the United States and one product into Mexico because they have the potential to be contaminated with Listeria monocytogenes. No illnesses have been reported. The products are being recalled as a precautionary measure given the health and safety of our consumers is our top priority. Pinnacle Foods initiated the recall after testing indicated the presence of Listeria monocytogenes in the plant environment. We are working in coordination with the Food and Drug Administration (FDA) on this recall.

Listeria monocytogenes is an organism which can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune systems. Although healthy individuals may suffer only short-term symptoms such as high fever, severe headache, stiffness, nausea, abdominal pain and diarrhea, Listeria infection can cause miscarriages and stillbirths among pregnant women.

All affected distributors and retail and food service customers are being notified and the affected products are being removed from store shelves.

This announcement applies only to the Aunt Jemima frozen products listed below and does not include any Aunt Jemima dry mixes and syrups.

Unilever is voluntarily recalling a limited number of boxes of Ben & Jerry’s Chocolate Fudge Brownie Pint Slices, which may inadvertently contain Vanilla Peanut Butter Cup Pint Slices. Although the slices were individually wrapped and identified as Vanilla Peanut Butter Cup Pint Slices, the ingredient peanut butter (containing the known allergen peanut), is undeclared on the outer product packaging. Persons who have an allergy or severe sensitivity to peanuts run the risk of a serious or life-threatening allergic reaction if they consume the product.

This limited voluntary recall is being conducted in cooperation with the U.S. Food and Drug Administration (FDA).

The affected product is sold in a paperboard box, containing 9 fL oz (266 mL) (3 individually wrapped ice cream slices) with UPC code of 076840657940 best by date AUG1218LT2 and lot number of AUG1218LT2.

The product was manufactured in the United States. The product was distributed nationwide and reached consumers through retail stores. No product was shipped outside of the U.S. No other Ben & Jerry’s products – besides this specific lot of Chocolate Fudge Brownie Pints Slices – are affected by this voluntary recall, including other Pint Slices, pints or any products served in Ben & Jerry’s franchised Scoop Shops.

The recall was initiated after receiving one consumer complaint, where it was discovered that Vanilla Peanut Butter Cups Pint Slices were distributed in outer packaging that did not call out the presence of peanut butter. Unilever has not received any reports of illness associated with this product, but the company is voluntarily recalling this product out of an abundance of caution.

Consumers who have purchased boxes of the above product with the affected UPC code and date code are asked to immediately discontinue use of the product, retain the outer box and call 877-270-7397, which is operational 24 hours a day, for more information about the recall and to request a replacement coupon. A consumer services representative is available between the hours of 8:30 AM and 5:00 PM EDT.

Frito-Lay is voluntarily recalling select Jalapeno Flavored Lay’s Kettle Cooked potato chips and Jalapeno Flavored Miss Vickie’s Kettle Cooked potato chips due to the potential presence of Salmonella in the seasoning.

The action comes after a supplier’s recent recall of a seasoning blend which includes jalapeno powder that could contain Salmonella. No Salmonella was found in the seasoning supplied to Frito-Lay. However, the company has decided to recall these products out of an abundance of caution, according to the FDA.

Products covered by the recall were distributed in retail stores and via foodservice, vending and other channels throughout the U.S.

The following product information is listed below:

All sizes of the following two products that have a “guaranteed fresh” date of JUL 4 or prior printed on the front upper panel of the package:

  • Jalapeño Flavored Lay’s Kettle Cooked potato chips
  • Jalapeño Flavored Miss Vickie’s Kettle Cooked potato chips

All of the following multipack offerings that have a “use by” date of JUN 20 or prior printed on the multipack package. The little-known institution behind dozens of store cards must refund $61.5 million to credit card holders for false marketing of payment protection programs, the Federal Deposit Insurance Corp. announced Tuesday.

Comenity Bank in Wilmington, Delaware, and Comenity Capital Bank in Salt Lake City, Utah, entered a settlement with regulators over the marketing of its “Account Assure” and “Account Assure Pro” add-on products. Payment protection is an insurance-like product that is supposed to cover your credit card payments in an emergency such as job loss.

The banks, units of Alliance Data Systems Corp., back cards from niche retailers ranging from Abercrombie and Victoria’s Secret to Zgallerie. According to documents on file with the U.S. Consumer Financial Protection Bureau, the two Comenity units stood behind about 150 store cards as of the first quarter of 2014.

“Consumers who are eligible for relief under the settlement are not required to take any action to receive restitution,” the FDIC announcement said. The violations occurred between January 2008 and September 2014. People with a current account should receive a statement credit, while others should receive a check by mail, the FDIC said. Refunds will begin after the FDIC approves a refund plan to be submitted by the company within 30 days.

The FDIC says the Comenity units violated the Federal Trade Commission Act by falsely:

  • Telling customers they wouldn’t be charged a fee if they didn’t carry a balance.
  • Assuring customers fee refunds would be issued to those who canceled coverage within 30 days.
  • Promising gift cards or account credits for enrolling in the program.

The order also states that the banks must clearly explain all the requirements that cardholders must meet in order to receive account credits or gift cards that are promoted as incentives to enroll in Account Assure.

The misstatements often occurred when cardholders were transferred to third-party salespeople after calling to activate their cards, the FDIC said. Cardholders may be due a refund for more than one violation. The FDIC will audit the banks’ refund efforts.

In addition to the refunds being paid to customers, the Comenity banks will pay $2.5 million in civil penalties to the FDIC. (Update: Comenity has set up a website with details about the refunds, which says the refunds were to be distributed beginning in the first quarter of 2016.)

Industrywide crackdown
Tuesday’s announcement brings to 11 the number of banks and third-party marketing companies that have been ordered to refund their customers for their marketing practices of add-on credit card products. In all, the companies have been ordered to repay almost $2.5 billion in refunds to nearly 21 million customers.

The following lists Comenity card agreements filed at the U.S. Consumer Financial Protection Bureau as of the first quarter of 2014. Not all the cards necessarily participated in the add-on products subject to refunds. The list excludes duplicate names and agreements where the merchant’s name does not appear.
