Frito-Lay is voluntarily recalling select Jalapeno Flavored Lay’s Kettle Cooked potato chips and Jalapeno Flavored Miss Vickie’s Kettle Cooked potato chips due to the potential presence of Salmonella in the seasoning.

The action comes after a supplier’s recent recall of a seasoning blend which includes jalapeno powder that could contain Salmonella. No Salmonella was found in the seasoning supplied to Frito-Lay. However, the company has decided to recall these products out of an abundance of caution, according to the FDA.

Products covered by the recall were distributed in retail stores and via foodservice, vending and other channels throughout the U.S.

The following product information is listed below:

All sizes of the following two products that have a “guaranteed fresh” date of JUL 4 or prior printed on the front upper panel of the package:

  • Jalapeño Flavored Lay’s Kettle Cooked potato chips
  • Jalapeño Flavored Miss Vickie’s Kettle Cooked potato chips

All of the following multipack offerings that have a “use by” date of JUN 20 or prior printed on the multipack package. In addition, a “guaranteed fresh” date of JUL 4 or prior is printed on the front upper panel of the individual recalled product packages inside each multipack offering. Any other products or flavors contained in these multipacks are not being recalled.

  • 12 count Lay’s Kettle Cooked Multipack Sack
  • 20 count Frito-Lay Bold Mix Sack
  • 30 count Miss Vickie’s Multipack Tray
  • 30 count Lay’s Kettle Cooked Multipack Tray
  • 32 count Miss Vickie’s Multipack Box

No other flavors of Lay’s Kettle Cooked potato chips or Miss Vickie’s potato chips are impacted or being recalled. Jalapeno Cheddar Flavored Lay’s Kettle Cooked 40% Less Fat potato chips are not impacted or being recalled.

The little-known institution behind dozens of store cards must refund $61.5 million to credit card holders for false marketing of payment protection programs, the Federal Deposit Insurance Corp. announced Tuesday.

Comenity Bank in Wilmington, Delaware, and Comenity Capital Bank in Salt Lake City, Utah, entered a settlement with regulators over the marketing of its “Account Assure” and “Account Assure Pro” add-on products. Payment protection is an insurance-like product that is supposed to cover your credit card payments in an emergency such as job loss.

The banks, units of Alliance Data Systems Corp., back cards from niche retailers ranging from Abercrombie and Victoria’s Secret to Zgallerie. According to documents on file with the U.S. Consumer Financial Protection Bureau, the two Comenity units stood behind about 150 store cards as of the first quarter of 2014.

“Consumers who are eligible for relief under the settlement are not required to take any action to receive restitution,” the FDIC announcement said. The violations occurred between January 2008 and September 2014. People with a current account should receive a statement credit, while others should receive a check by mail, the FDIC said. Refunds will begin after the FDIC approves a refund plan to be submitted by the company within 30 days.

The FDIC says the Comenity units violated the Federal Trade Commission Act by falsely:

  • Telling customers they wouldn’t be charged a fee if they didn’t carry a balance.
  • Assuring customers fee refunds would be issued to those who canceled coverage within 30 days.
  • Promising gift cards or account credits for enrolling in the program.

The order also states that the banks must clearly explain all the requirements that cardholders must meet in order to receive account credits or gift cards that are promoted as incentives to enroll in Account Assure.

The misstatements often occurred when cardholders were transferred to third-party salespeople after calling to activate their cards, the FDIC said. Cardholders may be due a refund for more than one violation. The FDIC will audit the banks’ refund efforts.

In addition to the refunds being paid to customers, the Comenity banks will pay $2.5 million in civil penalties to the FDIC. (Update: Comenity has set up a website with details about the refunds, which says the refunds were to be distributed beginning in the first quarter of 2016.)

Industrywide crackdown
Tuesday’s announcement brings to 11 the number of banks and third-party marketing companies that have been ordered to refund their customers for their marketing practices of add-on credit card products. In all, the companies have been ordered to repay almost $2.5 billion in refunds to nearly 21 million customers.

The following lists Comenity card agreements filed at the U.S. Consumer Financial Protection Bureau as of the first quarter of 2014. Not all the cards necessarily participated in the add-on products subject to refunds. The list excludes duplicate names and agreements where the merchant’s name does not appear.

RECALL ALERT: RUN and Check Your Boxes of Taquitos – Contaminated with Extraneous Materials

Ajinomoto Windsor, Inc., a Lampasas, Texas establishment, is recalling approximately 35,168 pounds of frozen ready-to-eat beef taquito products that may be contaminated with extraneous materials, specifically rubber with plastic, the U.S. Department of Agriculture’s Food Safety and Inspection Service (FSIS) announced today.

The frozen ready-to-eat beef taquito items were produced on December 30, 2016. The following products are subject to recall:

  • 60-oz. plastic bags inside of a corrugated carton labeled as “JOSÉ OLÉ TAQUITOS BEEF CARNE DE RES IN CORN TORTILLAS Crispy and Crunchy,” with case codes 3366365A, 3366365B, 3366365C, 3366365D and a Best By date of December 30, 2017.

The products subject to recall bear establishment number “Est. M-5590” inside the USDA mark of inspection. These items were shipped to retail locations in California, Florida, Illinois, Missouri, New York, Ohio, Pennsylvania, Texas, and Wyoming.

The problem was discovered when Ajinomoto Windsor, Inc. received two consumer complaints of foreign material in its ready-to-eat beef products on March 14, 2017 and March 21, 2017. The foreign materials were pieces of rubber with white plastic that originated from the establishments processing equipment.

There have been no confirmed reports of adverse reactions due to consumption of these products. Anyone concerned about an injury or illness should contact a healthcare provider.

Consumers who have purchased these products are urged not to consume them. These products should be thrown away or returned to the place of purchase.

FSIS routinely conducts recall effectiveness checks to verify recalling firms notify their customers of the recall and that steps are taken to make certain that the product is no longer available to consumers.

The United States Consumer Product Safety Commission recalled an Energizer-branded Xbox One controller charger on Wednesday, after customers reported overheating issues with the device.

“The battery chargers can overheat and damage the XBOX ONE video game controller, posing a burn hazard to consumers,” CPSC’s website said.

No injuries associated with the device have been reported. However, there were 24 reports of the charger malfunctioning.

Consumers should stop using the battery chargers and contact the charger’s maker, Performance Designed Products, for a full refund.

The Energizer Xbox One 2X Smart Chargers allow users to charge two controllers simultaneously, and feature indicator lights that tell the controllers’ charging status.

They were available at various technology-oriented stores nationwide until February 2017 and retailed for $40.

A total of 121,000 units were sold in the U.S. and an additional 7,250 were sold in Canada.

The chargers were manufactured in China.

The Ohio based firm has received about 140 reports of the swing breaking, including 39 injuries to children including abrasions, bruises, cuts and bumps to the head. Two of the reported injuries included children with a broken arm.

The Company Little Tikes is voluntarily recalling 540,000 toddler swings after 140 reports of the swing breaking, posing a fall hazard. There have been 39 reports of injuries, including two children with broken arms.

Thursday the US Consumer Product Safety Commission announced the recall of Little Tikes 2-in-1 Snug ‘n Secure pink toddler swings.

The recall includes swings manufactured in the United States from November 2009 through May 2014 with model number 615573 molded on the back of the seat.

Walmart, Toys “R” Us and other stores nationwide and online at www.littletikes.com and other websites from November 2009 through May 2014 for about $25.

LuLaRoe clothes are the latest rage these days. They are comfy, pretty and gals everywhere love them. The high price doesn’t seem to deter anyone from purchasing them BUT are you paying more than you have to? It seems there is a question of hidden surcharges built in and being claimed as taxes.

This is the claim being made by the lawsuit:

“[LuLaRoe’s] sales tax assessment practices, in effect, are improperly and fraudulently adding a surcharge to purchases, and are disguising those surcharges as a ‘sales tax’ that does not exists, and for which [LuLaRoe] lacks authority to collect or remit,” the lawsuit argues. “The ‘sales tax’ surcharge is more than the price advertised online for the product and purchasers do not become aware of this overcharge until Audrey sends them an invoice.”

Certain states, such as Pennsylvania, do not charge sales tax but buyers are still paying it. So who can be included in the proposed lawsuit against them?

The proposed class includes anyone in the United States who was or will be assessed a sales tax on clothes purchased and processed through LuLaRoe’s Audrey system, and whose purchases “were or will be delivered to tax jurisdictions of the United States that do not authorize a collection of sales tax on the clothing [the defendant] sells.”

Macy’s earnings topped analysts’ expectations Tuesday, but its top line fell short as it struggled to get consumers into its stores over the holiday period. The retailer sees tough times persisting during the fiscal year that just began, as shoppers continue to spend more of their money online.

As a result of this:

On the real estate side, Macy’s reiterated that it still plans to close another 34 stores or so over the next few years. In January, the company released a list of 68 stores that it plans to close, saying it eventually planned to reach 100.

Name of Product: Carbonating bottles

Hazard:  The bottles can burst under pressure, posing an injury hazard to the user or bystanders.

Units: About 51,000 (in addition, about 7,600 were sold in Canada)

Description: This recall involves SodaStream one liter, blue tinted, plastic carbonating bottles. “SodaStream” and “Dishwasher safe” are printed on the recalled bottles. Only bottles with an expiration date of “4/2020” printed on the warning label are included in the recall. The recalled bottles have a blue cap and blue bottom base.

Incidents/Injuries: None reported

Sold at: Bed Bath & Beyond, Target, Walmart and other stores and online at www.amazon.com and www.sodastream.com from February 2016 through January 2017 for about $15.
