LuLaRoe clothes are the latest rage these days. They are comfy, pretty and gals everywhere love them. The high price doesn’t seem to deter anyone from purchasing them BUT are you paying more than you have to? It seems there is a question of hidden surcharges built in and being claimed as taxes.

This is the claim being made by the lawsuit:

“[LuLaRoe’s] sales tax assessment practices, in effect, are improperly and fraudulently adding a surcharge to purchases, and are disguising those surcharges as a ‘sales tax’ that does not exists, and for which [LuLaRoe] lacks authority to collect or remit,” the lawsuit argues. “The ‘sales tax’ surcharge is more than the price advertised online for the product and purchasers do not become aware of this overcharge until Audrey sends them an invoice.”

Certain states, such as Pennsylvania, do not charge sales tax but buyers are still paying it. So who can be included in the proposed lawsuit against them?

The proposed class includes anyone in the United States who was or will be assessed a sales tax on clothes purchased and processed through LuLaRoe’s Audrey system, and whose purchases “were or will be delivered to tax jurisdictions of the United States that do not authorize a collection of sales tax on the clothing [the defendant] sells.”

Macy To Close More Stores!!!!

Another retail store is hit!

Macy’s earnings topped analysts’ expectations Tuesday, but its top line fell short as it struggled to get consumers into its stores over the holiday period. The retailer sees tough times persisting during the fiscal year that just began, as shoppers continue to spend more of their money online.

As a result of this:

On the real estate side, Macy’s reiterated that it still plans to close another 34 stores or so over the next few years. In January, the company released a list of 68 stores that it plans to close, saying it eventually planned to reach 100.

Name of Product: Carbonating bottles

Hazard:  The bottles can burst under pressure, posing an injury hazard to the user or bystanders.

Remedy: Refund

Consumers should immediately stop using the recalled carbonating bottles and contact SodaStream for a full refund.

Recall Details

Units: About 51,000 (in addition, about 7,600 were sold in Canada)

Description: This recall involves SodaStream one liter, blue tinted, plastic carbonating bottles. “SodaStream” and “Dishwasher safe” are printed on the recalled bottles. Only bottles with an expiration date of “4/2020” printed on the warning label are included in the recall. The recalled bottles have a blue cap and blue bottom base.

Incidents/Injuries: None reported

Sold at: Bed Bath & Beyond, Target, Walmart and other stores and online at www.amazon.com and www.sodastream.com from February 2016 through January 2017 for about $15.

This is just the latest in the string of store downsizings:

For decades, Toys “R” Us has stood as one of the most reliable and iconic sources of childhood glee. Now, that tradition is on shaky ground. This Friday, the company announced they had laid off between 10-15% of their home office employees out of Wayne, New Jersey — approximately 250 jobs were eliminated.

Amy Von Walter, Toys “R” Us EVP of Global Communication and PR, stated that, “The recent changes are not just about cost-containment—our growth plans require us to have the right structure, talent and determination to transform our business and achieve the financial objectives we’ve set for the company.”

Toys “R” Us, or TRU, has been struggling financially for some time. In 2005, investors led by KKR & Co., Bain Capital, and Vornando Realty Trust bought out the company for $6.6 billion. In 2016, the business refinanced its remaining $850 million debt load, allowing investors holding bonds maturing in 2017 and 2018 to swap their holdings for those maturing in 2021.

TRU has struggled to find new ways of operating as consumers shift to more online buying. People simply aren’t trekking to the malls that previously helped the toy chain dominate. Plus, savvy competitors like Walmart and Target have tripled their toy aisles & seasonal offerings during holiday season, allowing customers to cross TRU off the store list.

Amazon also cuts into sales as a major competitor, but it’s particularly painful as Toys “R” Us has historically had trouble getting products to customers. In 2015, they ran out of on-site goods which prompted TRU to try a new inventory algorithm, but ecommerce fulfillment issues were created as they underestimated holiday volume. Since the buyout ten years ago, the company has also been managed by no fewer than four CEOs:

Loblaw Companies Limited is recalling PC Organics brand baby food pouches from the marketplace because they may permit the growth of Clostridium botulinum. A manufacturing error resulted in excess water in the product, which under certain circumstances could support the growth of Clostridium Botulinum and pose a health risk to consumers. Consumers should not consume the recalled products described below.

Food contaminated with Clostridium botulinum toxin may not look or smell spoiled but can still make you sick. Symptoms can include nausea, vomiting, fatigue, dizziness, blurred or double vision, dry mouth, respiratory failure and paralysis. In severe cases of illness, people may die.

Feb. 17, 2017 – Sargento Foods Inc. of Plymouth, Wis. is voluntarily expanding the recall of cheese supplied by Deutsch Kase Haus, LLC due to potential contamination with Listeria monocytogenes that originated from the supplier’s facility. There have been no confirmed illnesses.

Out of concern for the health and well-being of Sargento consumers, the company has also terminated its relationship with Deutsch Kase Haus, which supplied Sargento with the affected Longhorn Colby cheese.

Out of an abundance of caution, in addition to the products recalled on February 10, 2017, we are also voluntarily recalling the following products which were packaged on the same lines.

Spin Master Corp. engaged in a bait and switch marketing scheme to convince parents and children that the Hatchimals interactive stuffed animal was the “it” gift of the 2016 Christmas season, according to a class action lawsuit filed last week in California federal court.

“Christmas is a time for family, religion, and for millions of eager children around the world, a time for presents,” plaintiff Jodie Hejduk says in the Hatchimals class action lawsuit. “Across the world, corporations and manufacturers clamor to produce the ‘it’ gift item of the season.”

Corporations that are successful in developing, manufacturing, producing and selling the season’s “it” gift often experience “a Christmas miracle in the form of millions, or potentially billions, of dollars,” the Hatchimals class action lawsuit states.

Hatchimals were reportedly highly coveted by children over the 2016 holiday season. The interactive stuffed animal is meant to “hatch” out of the colorful egg in which they are sold, bringing joy to children who are excited to find out what is inside.

According to the Hatchimals class action lawsuit, Spin Master launched the Hatchimals toy in October, providing plenty of time to generate consumer excitement before the holiday season. By November, the toys were sold out in many locations, leading to a black market for Hatchimals.

The toys were sold at a retail price of $50 to $60, but Hatchimals on the black market were selling for around $350, the Hatchimals class action lawsuit alleges.

Hejduk claims Spin Master engaged in a “brilliant” marketing campaign when it launched the Hatchimals toy. However, despite the toy company’s representations, many of the Hatchimals stuffed animals failed to “hatch” out of their eggs, which is one of the toy’s primary draws.

The false advertising class action lawsuit states that the Hatchimal’s packaging, instructions and the company website all indicate that it will take a total of up to 20 to 25 minutes for a Hatchimal to hatch out of the egg.

The Hatchimals class action lawsuit points to numerous online complaints from consumers who claim their Hatchimal failed to hatch despite following the instructions. At least one consumer reported breaking the shell to extract the Hatchimal, only to find that the batteries contained inside were dead. Once the batteries were replaced, the toy functioned as advertised, but the child was deprived of the anticipated “hatching” experience.

Hejduk says Spin Master took a “few token remedial measures” to address the issue, but they were ineffective. She says the company should have either volunteered to recall the product or offer reimbursements to consumers who purchased the defective Hatchimals product.

“This action is brought on behalf of millions throughout this country—for the dutiful parents who waited hours and days outside retail stores, the children who cried tears of joy upon unwrapping their very own Hatchimal, and the American consumer who places faith and trust that they are purchasing products that work for those they love the most,” the Hatchimals class action lawsuit says.

The Hatchimals class action lawsuit asserts violations of the California Consumer Legal Remedies Act, Unfair Competition Law and False Advertising Law. It also brings claims for unjust enrichment, breach of express warranty and injunctive relief.
